Applying for CPP Disability

Reconsideration Appeals
If Service Canada denies your application then your next step is the Reconsideration Appeal. This is an appeal directly with Service Canada. It will be decided by their medical adjudicators. Social Security Tribunal
If Service Canada denies your Reconsideration Appeal, then your next step is to appeal to the Social Security Tribunal of Canada. The Social Security Tribunal is separate from Service Canada. The decision-maker will now be a Tribunal member (judge), who are usually lawyers. Our disability lawyers help you buy determining how your case (as currently presented) is out of alignment with the expectations, beliefs and incentives of the tribunal judges. This tribunal hearing is your last chance to provide evidence and testimony. So you it is critical that you get it right. If you fail to present your case properly at the tribunal you can lose on legal technicalities, even though you should qualify for benefits. This could mean losing out on a lump sum payment of $20,000 to $40,000 plus monthly payments to age 65. Do not try to do this hearing on your own. There is too much at stake.
Why its so hard to win CPP disability
Winning CPP disability benefits is not easy. Service Canada approves some claims. But, most people get denied. For example, a 2016 Auditor General’s report looked at CPP disability. It found that Service Canada denied 60% of all applications. Further, it found 66% of those denied gave up.
So, why is CPP disability so hard to win? Even if your legitimately disabled? Because most people don’t know how to present their claim properly. Your claim is not approved based on the “truth” of your situation, rather, it is approved if you present the truth in a way the decision-maker can accept. You must meet the rules of evidence. Certain things must be supported by medical records or other documents. So, you must prepare your claim properly. You have to be convincing to the decision-maker. Otherwise, they will deny your claim.
