Disability claims only
We are one of a few law firms in Canada to focus exclusively on disability claims. We believe that no Canadian should be wrongfully denied disability benefits because of legal technicalities. This passion started with our founder’s personal experience seeking his grandfather being wrongfully denied benefits from a work injury claim.
Story alignment method
We invented The Story Alignment Method™, which is our signature process for handling disability claims. Using this process, we have achieved a success rate of well over 90%. We win by telling your best story. Others will come to see that going on disability was the last thing you wanted.
We are unique in that our founder and managing lawyer is a former occupational therapist. He worked as an occupational therapist in Canada and the United States before returning to law school. He started Resolute Legal for the purpose of representing people in disability claims.
We educate you first
We believe in educating you first. So you can make better decisions about your disability claim. We given away over 10,000 free books and guides aimed at helping people win their own disability claims. Our books include The Beginner’s Guide to CPP Disability and The CPP Disability Application Workbook. Both sell on Amazon.ca.
How our CPP disability lawyers help you
Applying for CPP Disability
We help you apply for CPP disability benefits. You can apply on your own using our self-help guides and courses. Or you can allow us to prepare your application for you. You may be able to win on your own, but having us prepare your application will give you the best chance for early approval.
If Service Canada denies your application then your next step is the Reconsideration Appeal. This is an appeal directly with Service Canada. It will be decided by their medical adjudicators. Our lawyer help you win this appeal by determining how your claim (as currently presented) fails to align with expectations, beliefs and incentives of the Service Canada Medical Adjudicator. This is part of our Story Alignment Process that has allowed us to achieve a success rate of over 90%.
Social Security Tribunal
If Service Canada denies your Reconsideration Appeal, then your next step is to appeal to the Social Security Tribunal of Canada. The Social Security Tribunal is separate from Service Canada. The decision-maker will now be a Tribunal member (judge), who are usually lawyers. Our disability lawyers help you buy determining how your case (as currently presented) is out of alignment with the expectations, beliefs and incentives of the tribunal judges. This tribunal hearing is your last chance to provide evidence and testimony. So you it is critical that you get it right. If you fail to present your case properly at the tribunal you can lose on legal technicalities, even though you should qualify for benefits. This could mean losing out on a lump sum payment of $20,000 to $40,000 plus monthly payments to age 65. Do not try to do this hearing on your own. There is too much at stake.
Why its so hard to win CPP disability
Winning CPP disability benefits is not easy. Service Canada approves some claims. But, most people get denied. For example, a 2016 Auditor General’s report looked at CPP disability. It found that Service Canada denied 60% of all applications. Further, it found 66% of those denied gave up.
So, why is CPP disability so hard to win? Even if your legitimately disabled? Because most people don’t know how to present their claim properly. Your claim is not approved based on the “truth” of your situation, rather, it is approved if you present the truth in a way the decision-maker can accept. You must meet the rules of evidence. Certain things must be supported by medical records or other documents. So, you must prepare your claim properly. You have to be convincing to the decision-maker. Otherwise, they will deny your claim.
For example, common reasons for denial include:
- lack of medical evidence
- your situation has “red flags”
- they think you can do other work
- you didn’t prove your disability started during your MQP
- they don’t believe you
