We know that getting the denial letter from the insurance company was one of the worst days of your life. You know you can't work...so how can they deny your claim?

If you are like most people we speak with, you didn't go on a sick leave at the first sign of trouble. Most likely you struggled for months (or even years) before finally taking an extended sick leave. You've likely worked yourself to the point of almost total breakdown.

Going on disability benefits was the last thing you wanted to do at this point in your life. This is why the arbitrary denial of disability payments is so frustrating. Once you got the denial letter, we expect your emotions ran the full spectrum from sad to angry.

You worked hard on the application for disability benefits, you had your doctor's support, but the insurance company still denied your claim. So what do you do now? Are concerned you may not know how to turn this thing around?

It is easy to doubt yourself and fall into despair. But now its the time to take action. You can turn things around, but you need to have a plan. Not just any plan. The Right Plan.

Let us give you a plan for success. We are a national disability claim law firm focused exclusively on helping people win disability payments, even after a denial or unsuccessful appeal. We have a A+ rating with the Better Business Bureau and operate using a online services delivery model. This means we serve you in your home and you never have to travel to our office.

Our founder David Brannen is a former occupational therapist turned disability lawyer, and author of the book A Beginner's Guide to Disability Insurance Claims in Canada. He leads a team that has been there and done that for just about every type of disability claim and scenario.

If the insurance company has denied your short or long-term disability claim, it is important to understand your rights and obligations. Depending on your situation, there could be many obligations and deadlines that apply to you. It is important that you take action to secure your employment rights while appealing the denial of disability insurance benefits.

A disability lawyer can help you in the following ways:

  • show you how to enforce your employment rights so you don't lose your job or medical benefits while appealing the disability insurance denial
  • get your claim file from the insurance company and analyze it to identify the "real" reasons your claim was denied and what actions are needed to win the appeal
  • identify mistakes made by the insurance company
  • identify the best strategy and action plan for your situation
  • take over communications with the insurance company so you don't have to deal with them anymore
  • write to your doctor to obtain a medical report that addresses the key issues need to win your appeal
  • write an appeal letter that argues why your claim should be approved
  • file a lawsuit against the insurance company for wrongful denial of disability benefits, infliction of mental distress, and other financial losses

If Service Canada has denied your application for CPP disability benefits, it is critical that you not miss the 90-day deadline to appeal. Your appeal strategy will be different depending on whether you are doing a Reconsideration Appeal (with Service Canada) or a Tribunal Appeal (to the Social Security Tribunal).

You must take special care when appealing your case to the Social Security Tribunal. There are technical requirements you must meet. There are tight deadlines for requesting the appeal and getting in documents before the hearing. Your tribunal hearing is essentially your "last kick at the can" so you have to get it right. Consult a disability lawyer early on in the process. If you wait until your hearing is fast approaching, or worse yet after you have lost your hearing, it may be too late for the lawyer to help you.

A disability lawyer can help you in the following ways:

  • get a complete copy of your CPP disability claim file from Service Canada
  • identify the best strategy and action plan for your situation
  • identify the gaps in evidence that need to be filled
  • obtain medical records, reports and other documents needed to win your appeal
  • prepare a persuasive written arguments (appeal letters and briefs) for why your claim should be approved
  • prepare you to testify at the Social Security Tribunal Hearing
  • attend your Social Security Tribunal Hearing to present the evidence and make oral arguments

THe Stakes are High

If the insurance company has denied your disability claim, then your current plan isn't working. There is no one-size-fits-all approach for appealing a disability denial. You need a customized plan to maximize your chances of success.

A successful plan will direct you to make the right decisions and to take the right actions to build a successful narrative. Every day you are taking actions and creating a narrative for your case...but is it the right narrative? You and your doctors have good intentions, but you could be digging a deeper hole. If you go too far in the wrong direction, it may become impossible to win your case. If you cement a losing narrative, it can become impossible to turn it around.

Your disability appeal strategy must ALSO account for your medical condition and Disability Benefits Provider

Your medical condition is a key factor in deciding the best strategy for your disability application and appeals. Resolute Legal's founder and managing lawyer is a former occupational therapist. We are experienced with disability claims involving many medical conditions and disabilities. We believe having a deep understanding of our clients' medical conditions is critical to success in winning appeals.

We have extensive experience with disability claims and have handled cases involving all many disability insurance companies, including Blue Cross, Desjardins, Great-West Life, Manulife, Industrial Alliance, SSQ, RBC Life, and more.

Hiring a lawyer is not easy. It's an important decision that you need to make carefully. Unfortunately many people dealing with a disability denial will rush the decision to hire a lawyer. This is understandable. You are under financial pressure. You can't bear any more phone calls with the insurance representative. You just want someone to take this burden off of your shoulders. A good lawyer can help with all of these things, but you have to make sure you choose a lawyer who is the right fit for you.

We have written a guide about how to hire a lawyer for a disability appeal. It includes and easy to follow 7 step process, which is the same process that many lawyers use when they have to hire a lawyer. We recommend you read this guide before you make a final decision on hiring a lawyer for a disability appeal.
