You need to make sure you are doing the right things and avoiding the mistakes that so many people make.

YOU NEED A PLAN to win your disability claim

As we expect you have now learned, being honest and legitimately unable to work is not enough to win disability payments. It is not enough to have a supportive doctor. YOU WILL LEARN:

After speaking with us, you will learn:

  • your appeal options
  • how to maximize your chances of success
  • how to protect your job...so you don't get fired when your claim gets denied
  • what is involved with hiring a lawyer or advocate to represent you
  • whether it makes sense for you to hire a lawyer

the Stakes are High

You can lose a winnable case. If your claim has already been denied, or if your payments were stopped, then your current plan isn't working. You need a new approach and if you have made mistakes, then you need to start damage control immediately. Your success with having benefits approved will depend on how you are perceived by the insurance company and others. Appearances matter, sometimes more than the truth. This doesn't mean you need to fake things or be dishonest, its just the opposite. You need to take actions that demonstrate your credibility and honesty. You need to do things that will fight the negative stereotypes others will try to put on you.

Disability Insurance Appeals

If the insurance company denied your short or long-term disability claim, it is important that you learn your rights, obligations and options before going any further with your appeal. You must be aware of all the deadlines that apply to you. You ned to choose the right strategy so you don't make mistakes that will make it harder or impossible to win later on. You need to be aware of all your options, so you don't choose the wrong appeal procedure and give up your legal rights. Speak with a disability law firm before going any further.

A disability law firm can help you with the following:

  • take over all communications with the insurance company...so you don't have to speak with them directly again
  • get a copy of your claim file from the insurance company
  • review the claim file to identify mistakes made by the insurance company and other gaps in information that can be fixed
  • write to your doctor to get a medical report that addresses all the key issues needed to approve your claim
  • prepare a comprehensive appeal letter or brief
  • file and appeal or lawsuit
  • negotiate a one-time lump-sum settlement with your insurance company

CPP Disability Appeals

Has Service Canada denied your application for CPP disability benefits? Don't give up, many people get approved for CPP disability benefits after being denied one or more times. You need to follow the appeal procedures. Keep in mind there are strict deadlines for appealing a denial of CPP disability benefits. You have 90 days to appeal at each level. The first appeal is called the Reconsideration Appeal. After that you have to appeal to the Social Security Tribunal. It is important to get advice from a disability law firm, even if you plan to do your own appeal. It is critical to use the right strategy or you claim will continue to be denied.

A disability law firm can help you as follows:

  • file the request for a Reconsideration Appeal
  • obtained medical records, reports and other documents to support your appeal
  • write a persuasive appeal letter
  • file a request for appeal to the Social Security Tribunal
  • prepare a comprehensive appeal brief for the Tribunal
  • attend the Tribunal hearing with you to run the hearing and make verbal submissions to the judge

LEARN HOW TO HIRE TO A DISABILITY LAWYER

Hiring a lawyer is not easy. It's an important decision that you need to make carefully. Unfortunately many people dealing with a disability denial will rush the decision to hire a lawyer. This is understandable. You are under financial pressure. You can't bear any more phone calls with the insurance representative. You just want someone to take this burden off of your shoulders. A good lawyer can help with all of these things, but you have to make sure you choose a lawyer who is the right fit for you.

We have written a guide about how to hire a lawyer for a disability appeal. It includes and easy to follow 7 step process, which is the same process that many lawyers use when they have to hire a lawyer. We recommend you read this guide before you make a final decision on hiring a lawyer for a disability appeal.
